The terms and conditions we use are usually in line with the standard wording from the NEC4 Engineering & Construction Subcontract as contained in Option X16 Retention.

Retention release stages

The NEC clause holds a percentage of amount due under the subcontract which is then reduced by 50% on completion of the subcontracted works and then the remaining 50% when Defects Certificate is issued.
The percentage for retention (usually between 2.5% and 5%) and the defects period is advised and agreed during the Subcontract Tender Period and included within the Subcontract Agreement signed by all parties.
