Retention circumstances

The purpose of the retention is to provide security for the satisfactory completion of works and the rectification of any defects identified following completion. Retention provisions are included within the relevant construction contracts. Where retention applies, contractors are typically entitled to payment of 95% of the certified value of works completed up to practical completion of the construction project. Following this, entitlement increases to 97.5%, with the remaining balance released at the end of the 12-month defect liability period once both parties are satisfied this is successfully completed. Retention is applied through the valuation and certification process in accordance with the relevant contract terms and is released once the applicable contractual conditions have been satisfied.
