Retention circumstances

Retention release
At six months from completion of the contract works half of the retention is released to the Contractor. The remaining balance is released on the two-year anniversary of first release of retention. Provided always that the Persimmon Group shall be entitled to withhold and retain from such retention (i) any monies expended on remedying any defects in the Contract Works and/or remedying any damage to Persimmon Group’s property or a customer’s property caused by the Contractor or any of its sub-contractors; and/or (ii) any monies properly due under the contract where Persimmon Group has either (a) incurred additional costs by employing an alternative contractor to execute the works (as and where permitted by the contract) or (b) where the Contractor has failed to rectify any defect in accordance with the contract, and such monies remain unpaid (but without prejudice in either case to any other rights of Persimmon Group in respect of such defects or damage or any other entitlement to set-off) and/or (iii) any monies due under an indemnity or any other liability or contracharges which may arise within the Contract
